ESPOS TERMS OF SERVICES

These Terms of Use together with Privacy Policy and Cancellation and Refund Policy, Set out the terms and condition for your use of CLIDOT Pvt Ltd. services.

Thank you for selecting Service Offered by CLIDOT Private Limited or its subsidiaries and affiliates (collectively, “ ESPOS”, “us”, “we” or “our”.) This Agreement is legal agreement between you and ESPOS. By accepting electronically) by clicking “I Agree”), installing, accessing or using the Services, you acknowledge / agree that you have read, understood and agreed to these terms, including on behalf of any person or entity for whom you are using this ESPOS Services. If you do not agree to this Agreement, then you may not use this Service.

If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have authority to bind such entity and its affiliates to these terms and condition as it authorized representative, in which case the terms “ you” or “ your” will be such entity and its affiliates as well as you.

“ Customer means the person or entity who register to use the ESPOS Services by creating a ESPOS account.

“ESPOS Service” means ESPOS’s point of sale billing software and hardware and other services, features, add-ons, technologies provided by those services and product offered by us from time to time including website easysalepos.com (“Website”), ESPOS Registration.

YOUR RIGHT TO USE OF SERVICES

You must be 18 years or older in order to access and use the ESPOS Services. You agree to provide accurate, latest and complete account information, and to maintain and promptly update your account information in order to ensure that it remains true, accurate, current and complete.
Your use will limits that apply to the our plan which you have purchased
The Service are protected by copy write. You are only granted the right to use the ESPOS Services and only for the purpose described by ESPOS. ESPOS reserves all other rights in the Services.
ESPOS grants you a limited, non -exclusive, non-transferable, revocable license to use the ESPOS Services in accordance with these Terms .
You agree you will not, Modify, copy , reproduce, deconstruct, sell or resell or trade the Services.

DISCLAIMERS

ESPOS does not promise that the Site and its content, service or feature of the site will be error – free or uninterrupted, or that any defects will be corrected, or that your use of the site will be provide specific result.

YOUR USE OF THIS SITE IS AT YOUR OWN RISK. THE SITE AND ITS CONETS ARE DELIVERED ON AN “AS IS” AND AS AVAILABLE BASIS. ALL INFORMATION PROVIDED ON THE SITE IS SUBJECTED TO CHANGE WITHOUT NOTICE. WE RESERVE THE RIGHT TO RESTRICT OR TERMINATE YOUR ACCESS TO THE SITE OR ANY FEATURE OR PART THERE OF AT ANY TIME. ESPOS DISCLAIM ANY WARRANTIES THAT ACCESS TO THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT THE SITE WILL BE SECURE, THAT THE SITE OR THE SERVER THAT MAKES THE SITE AVAILABLE WILL BE VIRUS FREE, OR THAT INFORMATION ON THE SITE WILL BE CORRECT, ACCURATE, ADEQUATE, USEFUL, TIMELY, RELIABLE OR OTHERWISE COMPLETE. IF YOU DOWNLOAD ANY CONTENT FROM THIS SITE, YOU DO SO AT YOUR OWN DISCRETE AND RISK. YOU WILL BE SOLEY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OR ANY SUCH CONTENT. NO ADVICE OR INFORMATION OBTAINED BY YOU FROM THE SITE SHALL CREATE ANY WARRANTY OF ANY KIND. YOUR SOLE REMEDY AGAINST ESPOS FOR DISSATISFACTION WITH THE SITE OR ANY CONTENT IS TO STOP USING THE SITE OR ANY SUCH CONTENT

The above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action.

ESPOS service reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the Site, or any portion of the Site, for any reason; (2) to modify or change the Site, or any portion of the Site, and any applicable policies or terms; and (3) to interrupt the operation of the Site, or any portion of the Site, as necessary to perform routine or non-routine maintenance, error correction, or other changes.

PAYMENT / FEE

The ESPOS Software Services are licensed on a quarterly or yearly subscription basis to the Customer that pays for the Services. Please review all the details of the subscription that you purchase. We change the fees or introduce new price plans and terms with a 30 days prior notice by email to registered email id. And the new price plan will apply to from expiry of that. Fee are charged in advance on a month or annual basis and are non-refundable. ESPOS Software Service activated within 24 hour, once the payment is credited.

CONTENT

You are legally responsible for any conduct or activity undertaken in your account including any changes made, and modification of or access to any data or any information data, text, software, sounds, graphics and other details on your account, by any of your Authorized Users. You are responsible for any Content that may be lost or unrecoverable through your use of the Services.

We will have no responsibility to anyone other than the Customer, and the ESPOS Services and these Terms are intended solely for the benefit of the Customer.

TERMINATION.

ESPOS may immediately , in its sole discretion and without notice terminate this Agreement or suspend the ESPOS Service if you fail to comply with this agreement. Upon termination you must immediately stop using the services and any outstanding payments will become due. ESPOS may terminate free account at any time.

CANCELLATION :

We can cancel your account any time on written notice to you via email. Such actions will be effective as the end of the subscription term. After the Subscription term ends, you will not have any access to the Service. there are no refunds upon cancellation. We may cancel your account immediately in our sole discretion :

If you have committed persistent breach of these Terms, or any other terms applying to your use of ESPOS service
If you fail to comply with any restrictions

You can entitle to cancel the account anytime. If you cancel the account, the account will get deactivated and all the rights granted under that term will be revoked. If you cancel your account before the end of your current package, your cancellation will take effect immediately and you will not be entitled to any refund of amount / fee paid in advance.

SHIPMENT

We ship items out as soon as possible, but this will not be always be same day as your order.

In General please add 1 -3 business days for order processing time, in order to prepare your item for shipping in our warehouse. if we anticipate a longer lead time, it will be noted in the item description.

Order shipped only on business day which are Monday – Friday.

Delivery usually takes 6 to 15 working days after the accepting the order

Shipment amount will be calculated at the checkout page by estimating the weight and location of order.

Hardware installation must be done by the customer as per the instruction manual provided with in the order delivered.
